The agreement for using BindVox — and who is responsible for what in a regulated industry.
These Terms govern your use of BindVox. By creating an account or using the service, you agree to them. If you are using BindVox on behalf of an agency, you represent that you have authority to bind that agency, and "you" includes the agency.
BindVox is software that helps a licensed insurance producer capture a client conversation, turn it into a structured application, and prepare quotes across carriers. It is a productivity tool. BindVox is not an insurance company, agency, broker, or producer, and does not give insurance, legal, or compliance advice.
The service is built so that a licensed human stays in control. The AI assists — it transcribes, drafts a structured application, suggests answers with the reasoning attached, and can fill a carrier's form fields on your behalf — but it never speaks to your client and never rates, submits, or binds an application on its own; the product is designed to stop before those actions and hand them to the licensed human. Filling a form enters data into the carrier's page; a licensed human reviews and performs the submit. You agree to use the product this way and to review its output before relying on it.
You must be a licensed insurance professional, or acting for a licensed agency, and hold the appointments and authority required for what you do in the product. You are responsible for your account, for keeping your credentials and any multi-factor device secure, and for activity under your account. Notify us promptly of any unauthorized use.
Because BindVox is a tool and you are the licensed professional, you are responsible for:
Do not use BindVox to break the law, to process data you have no right to, to attempt to access another tenant's data, to probe or disrupt the service or its security, to reverse-engineer it, or to submit false or fraudulent applications. Do not use it to interact with a third-party system in a way that violates that system's terms.
Our handling of account, applicant, and call data is described in the Privacy Policy, which is part of these Terms. For applicant and client information, BindVox acts as a service provider to your agency and processes that data on the agency's instructions.
BindVox and its software are ours. We grant you a limited, non-exclusive, non-transferable right to use the service while these Terms are in effect. The data you and your agency put into the product remains yours; you grant us the rights needed to operate and provide the service, consistent with the Privacy Policy.
BindVox helps you interact with carriers, rating platforms, and other third-party systems. We are not responsible for those systems, their availability, their decisions, or their terms. Your relationships and agreements with carriers and platforms are yours.
The service is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that automated transcription, extraction, or suggested quotes are accurate or complete — that is exactly why a licensed human must review them. BindVox does not guarantee any quoting, rating, or coverage outcome.
To the extent permitted by law, BindVox will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability arising out of or relating to the service will not exceed the amount you paid us for the service in the twelve months before the claim (or, if you paid nothing, one hundred US dollars). Nothing in these Terms limits liability that cannot be limited by law.
You will defend and indemnify BindVox against claims arising from your use of the service in violation of these Terms or applicable law, including claims relating to recording consent, the accuracy of applications you submit, or your regulatory obligations.
You may stop using BindVox at any time. We may suspend or terminate access for a breach of these Terms, for risk to the service or others, or as required by law. On termination, your right to use the service ends; data handling on termination follows the Privacy Policy and our agreement with your agency.
We may update these Terms as the product evolves. We will post the new version here with a new "last updated" date and, for material changes, provide additional notice. Continued use after a change means you accept it.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in California will have jurisdiction, except where applicable law provides otherwise.
